Subsumption, its Application in Judicial Decision

The choice of interpretive method or criterion by judicial operators when resolving disputes of their knowledge, is not a simple decision, because given the multiplicity of the hermeneutic function, it is essential to define the instruments that will be used for that purpose. Consideration must be given to the procedure to be adopted in the study and solution of the specific case, which implies a global theory of the social dependence of law, which includes extra-legal norms and values, relationships social, economics, politics and culture.
