Affiliation by Human Solidarity: a Legal Innovation or a Legal Obviousness of Mexican Family Law

The family is the original nucleus of society. Its composition is dynamic, as it is integrated, structured and restructured in various ways; always with the purpose of meeting the demands of society, depending on the time and place. The family is a very important institution for the legal field, among its members rights and obligations are generated. All people have the human right to form a family, in the way that is most comfortable for them; In addition, said decision must be protected by the State. To think that filiation only turns out to be the product of biological, clinical situations or civil procedures such as adoption, as established in the legal systems of Mexico, is to start from hermetic assumptions, since there are other forms of legal filiation such as that derived from human solidarity, this must be studied to know its legal scope in family courts.
