The application of the right to equality under the law in cases of denaturalization of pre-professional internships within the SECIGRA DERECHO program-Peru

The SECIGRA DERECHO pre-professional internship program is regulated by sui generis legislation and has specific conditions for its implementation. However, in case that these conditions are not adhered to, there is no legal protection for SECIGRA DERECHO participants, unlike the private sector where pre-professional interns are governed by Law No. 28518, the Law on Labor Training Modalities. Under this law, the concept of denaturalization is recognized, resulting in the establishment of an employment relationship between the intern and the company where they work. Given the similarity in functions and conditions between SECIGRA DERECHO participants and pre-professional interns in the private sector, and in accordance with the right of equality before the law, denaturalization of pre-professional internships within the SECIGRA DERECHO program should also be applied, for that purpose legislative reforms to protect SECIGRA DERECHO participants are needed.
